Terms of Service

These General Conditions of Use (hereinafter the "T & Cs") are offered by the organizer of virtual trade shows VinoVirtual, registered under SIRET number 789 462 009, hereinafter referred to as "VinoVirtual".

VinoVirtual SAS is the publisher of the VinoVirtual site under the internet address www.vinovirtual.online (hereinafter referred to as "the Site").

Eventtia, a simplified joint-stock company registered in the Paris Trade and Companies Register under number 805 005 086, whose head office is located at 10 rue de Penthièvre 75008 Paris, is the host of the VinoVirtual site.


APPLICATION OF T & Cs

The purpose of these T & Cs is to define all the conditions under which VinoVirtual allows users to use this Site (hereinafter the “Users”).

Any User declares to have read and accepted these T & Cs before using the Site. In the event that the User disagrees with one or more of the provisions of these T & Cs, he is requested not to use the Site.

ACCESS TO THE APPLICATION

Before any use of the Site, the User must ensure that he has the technical and IT resources enabling him to use the Site, in particular ensuring that the IT configuration of his mobile terminal is in good condition and does not contain virus.

VinoVirtual and its partner Eventtia implement all measures to ensure the User access to the Site, under optimal conditions, 24/24 and 7/7. VinoVirtual can in no way be held liable in the event of the unavailability of the site due to an internet failure, bugs or operating errors making it impossible to access the Site.

Access to the Site may also be temporarily interrupted in the event of maintenance operations.


USER ACCOUNT

To be able to use the Site, the User must first create a user account via www.vinovirtual.online.

It is the User's responsibility to maintain the confidentiality and security of their login credentials to the Site.

The User must immediately inform VinoVirtual of any unauthorized use of his identifiers. VinoVirtual cannot be held responsible for any loss or damage resulting from gross negligence or negligence on the part of the User in protecting their identifiers.


OBLIGATIONS OF USERS

The User undertakes to comply with all the provisions of these T & Cs.

The User agrees that he uses the Site for personal use for the purposes of professional meetings, in accordance with these T & Cs. In this regard, the User refrains from:

• To use the Site in any illegal manner, for any illegal purpose or in any manner incompatible with these T & Cs,

• To open more than one User account or to open an account impersonating a third party,

• To publish on the Site any content infringing the rights of third parties, in particular intellectual property rights,

• To sell, copy, reproduce, rent, lend, distribute, transfer or sub-license all or part of the content appearing on the Site or to decompile, extract, disassemble, modify, display in a form readable by the User, attempt to discover any source code or use any software activating or comprising all or part of the Site,

• To attempt to obtain unauthorized access to the Site's computer system or to engage in any activity that disrupts, decreases the quality or interferes with the performance or deteriorates the functionality of the Site,

• To use the Site for abusive purposes by intentionally introducing viruses or any other malicious program and to attempt to gain unauthorized access to the Site,

• To carry out activities that are illegal, fraudulent or undermine the rights or safety of third parties,

• To infringe the intellectual property rights of VinoVirtual.


PERSONAL DATA

The User is informed that VinoVirtual processes personal data belonging to him via the Site. The processing of personal data by VinoVirtual is further detailed in its privacy policy.

In accordance with the applicable regulations on the protection of personal data, the User has the right to oppose, access, limit, rectify, port and delete personal data concerning him, as well as a right of opposition for legitimate reasons and withdrawal of consent, by contacting VinoVirtual at the following address: hello@vinovirtual.fr.

The User also undertakes to communicate VinoVirtual's confidentiality policy to the persons whose personal data he collects via the Site.


RESPONSIBILITY

VinoVirtual makes every effort to guarantee uninterrupted access to the Site but can under no circumstances be held responsible if, in the event of unavailability linked to failure operations of the communication networks or for any other reason beyond its control, The User could not use the Site.

In the context of the simple provision of access to the Site, VinoVirtual acts as an event service provider and can under no circumstances be held liable for any prejudice or damage not directly caused by VinoVirtual.

In the event of cancellation of an appointment by the Users of the Site or if their progress did not give satisfaction or did not lead to a commercial agreement, the responsibility of VinoVirtual can in no way be engaged.

Finally, VinoVirtual cannot be held responsible for the non-performance of one of its contractual obligations due to the occurrence of a case of force majeure.


INTELLECTUAL PROPERTY

The Site and all of its elements and contents are protected by copyright, trademark law, designs and / or all other intellectual property rights. All of these rights are reserved for the whole world.

If the User provides the Site with any text, visual or graphic element for its promotion, he consents and authorizes VinoVirtual to use them on his internet and physical communication media as part of the event concerned.

No title or right whatsoever to any element or software will be obtained by downloading or copying elements from the Site. It is strictly forbidden for the User to reproduce (except for his personal and non-commercial use), publish, edit, transmit, distribute, show, remove, delete this Site and the elements and software it contains, no more than modify it or carry out any work taking these protected elements as a basis.

The name and brand of VinoVirtual, logos, designs, stylized letters, figurative marks, and all signs represented on this Site are and will remain the exclusive property of VinoVirtual. Any use by the User of the aforementioned elements, company names, brands and distinct signs belonging to VinoVirtual is strictly prohibited except in the event of the express prior agreement of VinoVirtual.


MEDIATION / LITIGATION

In the event of a dispute that may arise during the interpretation and / or execution of these Terms or in connection with these T & Cs, the User may decide to submit the dispute with VinoVirtual to a conventional mediation procedure or any other alternative dispute resolution method.


The User can go to the European platform for the settlement of consumer disputes set up by the European Commission at the following address and listing all the dispute settlement bodies approved in Europe: https://webgate.ec .europa.eu / odr /.


If this mediation procedure fails or if the User wishes to seize a court, any dispute will be settled before the competent French courts.
